The Bombay High Court, established in 1862, is one of the oldest High Courts in India, with jurisdiction over the states of Maharashtra, Goa, and the Union Territories of Dadra and Nagar Haveli and Daman and Diu. Headquartered in Mumbai, it also has benches in Nagpur, Aurangabad, and Panaji (Goa). It has been instrumental in upholding constitutional rights and delivering landmark judgments on civil liberties, property rights, corporate matters, and issues of public interest.
The Bombay High Court operates under the framework of the Indian Constitution and the Code of Civil Procedure and Criminal Procedure. It has played a significant role in shaping legal principles in areas like freedom of speech, women’s rights, environmental protection, and corporate governance. The court hears a wide range of cases, including civil, criminal, constitutional, and administrative matters, and has made significant contributions to the development of Indian jurisprudence.
In March 2022, BOOM fact-checked a viral message claiming that the Bombay High Court allowed students to wear the hijab.
BOOM found the message to be misleading. The court’s order in 2018 was specific to a case where a medical student was permitted to wear the hijab at college, setting a precedent for religious accommodations under certain circumstances. However, the order was not a blanket rule for all educational institutions, as falsely claimed in the viral message.
